mySubs Terms of Service

Please read these Terms of Service carefully before using the mySubs application. By downloading, installing, or using the application, you agree to be bound by these terms.

1. Purpose of the Application

mySubs is a local tool that allows users to manage their personal subscriptions privately. All information entered by the user is stored exclusively on the device, with no data being sent to or collected on external servers.

The application is designed for personal use, allowing users to track, organize, and receive reminders about their subscription services.

2. Privacy and Data

• This application does not collect, store, or share any personal data.
• Data entered by the user is stored exclusively on the user's device.
• The user may choose to export their information in JSON format to create backups or transfer their data to another device. This action is optional and entirely the user's responsibility.
• In accordance with Apple's privacy requirements, the application does not access any identifiable information without explicit user permission.
• The application does not use analytics, tracking tools, or any third-party services that would compromise user privacy.

3. Permitted Use

The user agrees to use the application solely for personal and legal purposes. The following activities are prohibited:

• Copying, modifying, or redistributing the app without permission.
• Reverse engineering or manipulating the source code.
• Using the app for commercial purposes without express authorization.
• Attempting to use the application to engage in fraudulent activities or violate any laws.
• Utilizing the application in any way that could damage, disable, overburden, or impair the service.

4. Intellectual Property and Use of Trademarks

The app may display logos or representative images of known subscription services solely to facilitate their identification by the user. These logos are the property of their respective brands and are used without the intention of officially representing these companies or acting on their behalf.

The images are displayed in reduced quality version and comply with the principle of fair use for identification and informational purposes.

All content in the application that is not third-party content, including design, text, graphics, interfaces, and the selection and arrangement thereof, is owned by the developer and is protected by copyright, trademark, and other applicable laws.

5. Limitation of Liability

The developer does not guarantee that the application will be free from errors or interruptions. Under no circumstances will the developer be liable for:

• Loss of data, even in the event of device failure.
• Any indirect damage resulting from the use or inability to use the app.
• Any damages or issues arising from the user's misuse of the application or failure to understand its features.
• Business losses, including loss of or damage to profits, income, revenue, anticipated savings, business, contracts, commercial opportunities, or goodwill.

Users are recommended to regularly back up their data using the export function available in the application.

In accordance with Apple's requirements, any dispute between the user and Apple will be resolved according to Apple's standard EULA policy for applications available on the App Store.

6. Purchases and Premium Features

mySubs – SubscriptionTracker offers a free basic version and a premium version that unlocks additional features through a one-time payment via the App Store.

• All transactions are processed through Apple's App Store platform and are governed by its own terms of use and refund policies.
• Once the one-time payment is made, access to premium features is permanently unlocked for the Apple account used for the purchase.
• If you reinstall the app or change devices, you can restore your purchase from the corresponding section of the app ("Restore purchases").
• No support is offered for transferring purchases between different Apple accounts.
• The developer does not have access to or store payment-related data and cannot directly manage refunds. For any refund inquiries, you should contact Apple support.

7. Changes to Terms

We reserve the right to modify these terms at any time. Updated versions will be available at:

Your continued use of the application after changes to the Terms constitutes your acceptance of the new Terms. If you do not agree to the changes, you should uninstall the application.

8. Applicable Law

These terms are governed by the laws of the Kingdom of Spain. Any legal dispute will be resolved in the courts of the city where the developer resides.

For users in the European Union, these terms do not affect your statutory rights as a consumer.

9. Apple-Required Terms

In accordance with Apple's App Store Review Guidelines:

• These Terms of Service are between you and the developer, not with Apple. Apple is not responsible for the application and its content.
• The license granted is limited to a non-transferable license to use the application on Apple-branded products that you own or control, as permitted by the App Store Usage Rules.
• Apple has no obligation whatsoever to furnish any maintenance and support services with respect to the application.
• In the event of any failure of the application to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for the application to you. To the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the application.
• Apple is not responsible for addressing any claims by you or any third party relating to the application or your possession and/or use of the application, including, but not limited to: (i) product liability claims; (ii) any claim that the application fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection or similar legislation.
• In the event of any third-party claim that the application or your possession and use of the application infringes that third party's intellectual property rights, the developer, not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of any such intellectual property infringement claim.
• You represent and warrant that (i) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.
• Apple and its subsidiaries are third-party beneficiaries of these Terms of Service and, upon your acceptance of the terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms of Service against you as a third-party beneficiary thereof.
